Used Vehicle Sales Fuel Discount Membership Terms and Conditions.
These Terms and Conditions constitute the basis of the Used Vehicle Sales Fuel Discount Bonus.
Used Vehicle Sales reserves the right to update or amend these terms and conditions by posting the amended terms and conditions at www.usedvehiclesales.com.au/fuel_discount_bonus. It is your responsibility to check the terms and conditions regularly for any changes.
1 Membership
You are applying for membership of the Used Vehicle Sales Fuel Discount Membership. If your application is successful, you will be issued with a Used Vehicle Sales Fuel Discount membership number, which must be quoted when making a Used Vehicle Sales Fuel Discounting Bonus claim.
2 Collecting Fuel Discounts
You may credit fuel discounts to your membership account for all eligible purchases. Fuel discounts may also be credited to a member’s account for promotional and incentive programs offered by Used Vehicle Sales (at the sole discretion of Used Vehicle Sales) from time to time.
In order to obtain fuel discounts, a member shall purchase eligible goods and services and then must provide proof of the purchase transaction by submitting a clear legible photograph of the transaction invoice by SMS to the number provided.
A member shall submit a single invoice showing proof of transaction, one time per week for the duration of the entitlement period. Fuel discounts will only be credited for one type of fuel only, purchased in a single transaction up to a maximum amount of fuel the vehicle’s fuel tank can hold.
Used Vehicle Sales is not liable for any failure of a member to notify Used Vehicle Sales of the transaction nor due to a system malfunction or any other reason.
Fuel discounts cannot be sold, transferred, assigned or otherwise dealt with except in accordance with these Terms and Conditions. Fuel discounts are credited to your membership account as a rebate amount, which represents the aggregate total of eligible purchases submitted during the entitlement period.
Members will be notified by email monthly of the value of the fuel discounts and rebate amount recorded on their membership account.
3 Rebating Fuel Discounts
A member who has accumulated fuel discounts on his or her membership account will qualify to have a single monthly deposit made into their nominated bank account.
The amount deposited into the member’s bank will be:
the dollar value equivalent of litres purchased and submitted up to a maximum purchase of fifty (50) litres of fuel per week multiplied by the fuel discounts recorded on the member’s membership account expressed as cents per litre.
If the amount to be credited is less than $5.00, it will sit against the members account until the balance is higher than $5.00, at which point it will be remitted.
All accumulated fuel discounts can be used only once, and will be deducted from the member’s membership account following redemption.
4 Termination of the Used Vehicle Sales Fuel Discount Membership
Used Vehicle Sales reserves the right at its absolute discretion to suspend or terminate the Used Vehicle Sales Fuel Discounting Membership at any time without prior notice to members. Used Vehicle Sales will not be liable for, and will not provide any refund, compensation or any other form of payout, as a result of the suspension or termination of the Used Vehicle Sales Fuel Discount Membership on any account whatsoever including (without limitation) the balance of any discounts recorded on a member’s membership balance at the time of suspension or termination.
5 Warranties and Liabilities
To the extent permitted by law, Used Vehicle Sales takes no responsibility for, and will not be liable in any way for any conditions, guarantees and warranties provided by merchants, and all conditions, guarantees and warranties, whether express or implied and whether arising under statute or otherwise, as to the condition, suitability, quality, fitness or safety of any goods or services supplied under the Used Vehicle Sales Fuel Discount Membership System are expressly excluded by Used Vehicle Sales. Any liability Used Vehicle Sales may have to a member under statute or otherwise in respect of such goods and services which cannot be excluded is limited, to the extent permitted by law, to the value of the fuel discount balance remaining.
Any liability that Used Vehicle Sales may have to a member for negligence, breach of contract or otherwise is limited in any case to the lesser of the dollar value of the member’s accumulated fuel discounts at the time the liability arose, and fifty dollars ($50.00).
The total accumulated value of all redeemables on a Used Vehicle Sales card may not exceed a maximum of $900 at any time.
Participating merchants do not have authority, express or implied, to make any representation, warranty or statement on behalf of Used Vehicle Sales. Used Vehicle Sales accepts no liability in respect of such representations, warranties or statements.
6 In these Terms and Conditions
“fuel discounts” means the fuel discount amount which a member has accrued under the Used Vehicle Sales Fuel Discounting Membership, which is recorded on the member’s membership account, and which has not expired;
“Used Vehicle Sales” means Zepher Holdings Pty Ltd ABN 23 212 295 355 and/or their nominee(s) jointly and severally and their permitted assigns, related bodies corporate and authorised representatives. The term “related bodies corporate” has the same meaning as in the Corporations Act 2001;
“Used Vehicle Sales Fuel Discounting System” means the system operated by Used Vehicle Sales whereby members that have accrued fuel discounts by referring buyers to Used Vehicle Sales may redeem their accumulated fuel discounts for a discount off the price of fuel purchased in accordance with these Terms and Conditions;
“Used Vehicle Sales Fuel Discounting Membership logo” means the logo approved by Used Vehicle Sales Pty Ltd and displayed at the bottom of these Terms and Conditions;
“Used Vehicle Sales Fuel Discounting membership purchase transaction” means the purchase of fuel by a member which is subject to the Used Vehicle Sales Fuel Discounting System;
“eligible purchase’ means a purchase of fuel by a member, which is subject to the Used Vehicle Sales Fuel Discounting Bonus;
“entitlement period” means the period for which a member is entitled to participate in the Used Vehicle Sales Fuel Discount Bonus.
“eligible goods and services” means petrol (leaded and unleaded), diesel, or automotive LPG purchased at any petrol outlets.
“fuel” means petrol (leaded and unleaded), diesel, or automotive LPG purchased at any petrol outlets.;
“fuel discounts” means the discounts provided under the Used Vehicle Sales Fuel Discounting membership, expressed as “cents off per litre” of the price of fuel purchased;
“member” means a person who has applied to be a member of, and who Used Vehicle Sales has approved as a member of, the Used Vehicle Sales Fuel Discounting Membership;
